TANGGUNG JAWAB NEGARA MYANMAR TERHADAP KEBEBASAN BERSERIKAT BAGI SERIKAT PEKERJA YANG DIATUR DALAM KONVENSI ILO NOMOR 87 TAHUN 1948 TENTANG KEBEBASAN BERSERIKAT DAN PERLINDUNGAN HAK UNTUK BERORGANISASI
Abstract
Abstract
Freedom of association is one of the principles in Human Rights which adopted into the ILO Convention No. 87 of 1948 on Freedom of Association and Protection of the Right to Organize. This convention has been ratified by various member states of the International Labour Organization (ILO) including Myanmar. The ratification of this convention makes the state of Myanmar has a responsibility to protect freedom of association in their domestic rules, but considering in Myanmar there are often coups, this situations has implication on many things including the protection of freedom of association for trade unions in Myanmar.
Based on the research data that has been conducted, the state of Myanmar as a party to ratify the ILO Convention No.87 of 1948 on Freedom of Association and Protection of the Right to Organize has carried out its responsibilities to this convention in particular by promulgated the Labour Organization Law 2011 as a domestic rule concerning the freedom of association which has been regulated on ILO Convention No.87 of 1948 on Freedom of Association and the Right to Organize.

Abstrak
Kebebasan berserikat merupakan salah satu prinsip dari Hak Asasi Manusia yang diadopsi kedalam Konvensi ILO No. 87 Tahun 1948 tentang Kebebasan Berserikat dan Perlindungan Hak untuk Berorganisasi. Konvensi ini telah diratifikasi oleh berbagai negara anggota International Labour Organization (ILO) termasuk Negara Myanmar. Adanya ratifikasi atas Konvensi ini menjadikan negara Myanmar memiliki tanggung jawab untuk melindungi kebebasan berserikat dalam aturan domestik mereka, tapi mengingat di Myanmar seringkali terjadi kudeta hal ini menimbulkan implikasi pada banyak hal termasuk terhadap perlindungan kebebasan berserikat bagi serikat pekerja di Myanmar.
Berdasarkan pembahasan terhadap data penelitian yang telah dilakukan, Negara Myanmar sebagai pihak yang meratifikasi Konvensi ILO No.87 Tahun 1948 tentang Kebebasan Berserikat dan Perlindungan Hak untuk Berorganisasi telah menjalankan tanggung jawabnya pada Konvensi ini khususnya dengan mengesahkan Labour Organization Law 2011 sebagai aturan domestik terkait kebebasan berserikat yang telah diatur dalam Konvensi ILO No.87 tahun 1948 tentang Kebebasan Berserikat dan Hak untuk Berorganisasi.
