ANALISIS KEBEBASAN BERKONTRAK DALAM SMART CONTRACT E-COMMERCE

Abstract
This article aims to analyze how the implementation of the principle of freedom of contract in smart contract e-commerce. Using the normative juridical method, this article concludes that the standard e-commerce agreement has not fulfilled the principle of freedom of contract and has not reflected the values of justice, balance, and proportionality. The contents of the agreement have been made unilaterally. Therefore, further studies are needed to provide space for the parties to negotiate the e-commerce sale and purchase agreement.
Abstrak
Tujuan dari penulisan artikel ini adalah untuk mengetahui bagaimana penerapan asas kebebasan berkontrak dalam perjanjian baku smart contract e-commerce. Dengan menggunakan metode yuridis normatif, maka kesimpulan dari artikel ini adalah bahwa perjanjian baku smart cotract e-commerce tersebut belum memenuhi asas kebebasan berkontrak dan belum mencerminkan nilai keadilan, keseimbangan dan proporsionalitas karena isi perjanjian telah dibuat secara sepihak. Oleh karena itu diperlukan kajian lebih lanjut untuk memberikan ruang agar para pihak dapat bernegosiasi dalam perjanjian jual beli e-commerce.
