Abstract
Trademark rights as movable and intangible objects because they can be bought or sold and have economical value should have the opportunity to be used as collateral objects. In accordance with the principle of specialization, guaranteed trademark rights must be proven by a trademark certificate as a sign that the trademark has been registered. However, the Trademark and Geographical Indications Law does not explicitly regulate what collateral institutions can cover trademark rights. The problem is what are the criteria and implementation of brand rights as collateral objects to obtain credit? The method used in this type of research is normative legal research. The results of the study brand rights can be used as credit collateral because they have the characteristics contained in material security rights, such as the brand is the property or personal property of the brand owner; has economic value; movable or hand-transferable; has the characteristic of droit de suite, namely following the object wherever the object is.
Abstrak
Hak Merek sebagai benda bergerak dan tidak berwujud karena dapat diperjualbelikan dan memiliki nilai ekonomis seharusnya mempunyai kemungkinan untuk dijadikan sebagai objek jaminan. Menurut asas spesialitas, hak merek yang dijaminkan harus dibuktikan dengan adanya sertifikat merek sebagai tanda telah didaftarkannya merek tersebut. Namun, dalam UU Merek dan Indikasi Geografis tidak diatur secara eksplisit mengenai lembaga jaminan apa yang dapat membebani hak merek. Adapun permasalahan agaimana kriteria dan pelaksanaan hak merek sebagai objek jaminan untuk mendapatkan kredit? Metode yang digunakan jenis penelitian ini adalah penelitian hukum normatif. Hasil penelitian hak merek dapat dijadikan sebagai jaminan kredit karena memiliki sifat-sifat yang terdapat dalam hak jaminan kebendaan seperti merek merupakan kepunyaan atau hak milik pribadi pemilik merek; mempunyai nilai ekonomi; dapat dipindahtangankan atau dialihkan; mengikuti bendanya dimanapun benda itu berada (sifat droit de suite).
